These Terms of Service (“Terms,” “Agreement”) are a legal agreement between you (“User,” “you”) and PumpPal (“Company,” “we,” “us”) governing your use of the PumpPal mobile application and website (collectively, the “Service”).

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

Acceptance of Terms

By creating an account, downloading our mobile application, or otherwise accessing or using the Service, you represent that:

• You have the legal capacity to enter into this Agreement
• You will comply with all applicable laws and regulations
• All information you provide is accurate and truthful

Description of Service

PumpPal is a mobile application and web service designed to help breastfeeding and pumping parents track their pumping sessions, monitor milk supply, set goals, and manage their pumping journey. Our Service includes:

• Session tracking with timers, volume recording, and note-taking capabilities
• Data analytics and visualization of pumping patterns and trends
• Goal setting and progress tracking features
• Reminder and notification systems
• Data export functionality for sharing with healthcare providers
• Photo storage for session documentation

User Accounts and Registration

To access certain features of the Service, you must create an account. You agree to:

• Accept responsibility for all activities that occur under your account

Content Guidelines

When uploading photos or adding notes to your sessions, ensure that content:

• Is appropriate and relevant to pumping/breastfeeding
• Does not contain personally identifiable information of others
• Respects privacy and confidentiality
• Complies with applicable laws and regulations

User Content and Data

You retain ownership of the content and data you upload to the Service (“User Content”), including session data, photos, and notes. By using the Service, you grant us a limited, non-exclusive license to:

• Store, process, and display your User Content as necessary to provide the Service
• Use aggregated, anonymized data for analytics and service improvement
• Enable features like data export and sharing (only with your explicit permission)

You represent and warrant that:

• You own or have the necessary rights to your User Content
• Your User Content does not infringe on others' rights
• Your User Content complies with these Terms and applicable laws

Privacy and Data Protection

Subscription and Payment Terms

PumpPal may offer both free and premium features. Premium features may require a subscription or one-time payment.

Billing and Renewals

• Subscriptions automatically renew unless cancelled before the renewal date
• You will be charged through your app store account (Apple App Store or Google Play Store)
• Prices are subject to change with reasonable notice
• Refunds are handled according to the app store's refund policy

Free Trial

We may offer free trials for premium features. At the end of the trial period, you will be automatically charged unless you cancel before the trial expires.

Termination

You may terminate your account at any time by following the cancellation procedures in the app or contacting us directly.

We may terminate or suspend your account and access to the Service, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will cease immediately. Your User Content may be deleted, though we may retain certain information as required by law or for legitimate business purposes.

Disclaimers and Warranties

Service Availability: The Service is provided “as is” and “as available” without any warranties of any kind. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including:

• Warranties of merchantability and fitness for a particular purpose
• Warranties regarding accuracy, reliability, or completeness of information
• Warranties that the Service will meet your specific requirements
• Warranties that data will be completely secure or never lost

Limitation of Liability

To the fullest extent permitted by applicable law, PumpPal shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, or business opportunities
• Loss of data or information
• Cost of substitute services
• Personal injury or property damage
• Any damages arising from your use or inability to use the Service

Our total liability to you for all claims arising out of or relating to these Terms or the Service shall not exceed the amount you paid us for the Service in the twelve months preceding the claim.

Some jurisdictions do not allow the limitation of liability for personal injury or incidental or consequential damages, so these limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless PumpPal and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your User Content

Dispute Resolution and Arbitration

Informal Resolution: Before filing a claim, you agree to contact us at support@pumppalapp.com to seek informal resolution of any dispute.

Binding Arbitration: If informal resolution fails, any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if they qualify.

Class Action Waiver: You agree that any arbitration shall be conducted on an individual basis and not as a class action, and you waive any right to participate in a class action lawsuit or class-wide arbitration.

The arbitration will be conducted in accordance with the rules of the American Arbitration Association and will take place in Kirkland, Washington.

Governing Law

These Terms shall be interpreted and governed by the laws of the State of Washington, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts of King County, Washington.

Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

We will notify you of changes by:

• Posting the new Terms on this page
• Updating the “Last updated” date
• Sending an email notification for significant changes
• Providing an in-app notification

Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

Severability and Waiver

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or any other term.

Entire Agreement

These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the sole and entire agreement between you and PumpPal regarding the Service and supersede all prior and contemporaneous understandings, agreements, representations, and warranties.
